Objectives This subject aims to provide students with understanding of the common law rules governing contracts of employment and contracts for services as derived from the basic principles of contract and their application to industrial relations. Students will also gain a working knowledge of current legislation governing the management of staff, industrial disputes, and some knowledge of the industrial jurisdiction of at least one Australian state or territory. On completion of this subject students should have not only been introduced to these concepts, but also have gained an understanding of the need for alertness among managers to industry, industrial associations and parliamentary changes, and to be able to conduct their own research into the relevant employment areas.

Synopsis Current Australian industrial relations law, contracts of employment, common law provisions governing the employer-employee relationship in contracts of employment, recruitment law, equal opportunity and anti-discrimination law, sexual harassment terminations, unfair dismissals, employer-employee duties of care, health and safety in the work environment, vicarious liability and industrial action.

Assessment Written assignment (2000 words): 30% · Examination (3 hours): 70%
