Objectives The subject will provide understanding of the Australian Constitution and the principal political structures and conventions. It aims also to develop an understanding of, and capacity to apply, the major grounds of administrative review, particularly ultra vires and procedural fairness, both at law and as adopted in the administrative decisions (Judicial Review) Act (Commonwealth). Students will be able to recognise problems in administrative law and understand the processes required to seek a remedy.
Synopsis Ultra vires, natural justice, jurisdictional error, delegated legislation administrative decisions (judicial review) act, administrative appeals tribunal, freedom of information legislation, remedies and orders.
Assessment Assignments: 30% · Examination (3 hours): 70% · Students must achieve 50% in the unit and the final examination to pass the unit.
