Library regulations


Regulations made pursuant to Statute 5.2 The University Library

1. In these regulations unless the contrary intention appears -

`authorised library officer' means the university librarian, the deputy university librarian, an associate librarian, and the librarian in charge of a branch library;

`fine' does not include a monetary penalty imposed pursuant to section 21.1 or section 22.2;

`identity card' means the university's official identity card, or such other means of identification as may be required to borrow library materials;

`late return' means the return or non-return of library materials after the date the materials should have been returned;

`library staff member' means a person appointed to the library staff on a full-time, part-time or casual basis;

`library user' means a person who is present in the library for a purpose other than official duties associated with the administration of the library;

`loans desk' means that point in each library of the university at which loan transactions are carried out;

`member of staff' means a member of the teaching staff as defined in Statute 1.1 - Interpretation and any other person or a person in a category as is determined by the university librarian from time to time;

`misconduct' means conduct in the Library which is contrary to the statutes or regulations of the university or the Crimes Act 1958 or Summary Offences Act 1966 of the State of Victoria;

`notice' includes a notice of demand;

`overnight loan' means a loan of a book which is stamped `overnight' inside the book cover;

`periodical' means an item held in the periodicals section of each library and includes a law report and principal or subordinate legislation;

`reserve book' means a book from a reserve collection designated accordingly;

`reserve desk' means that point in each library from which reserve books may be obtained or to which they must be taken in order to record their removal from the reserve book area;

`students', `graduate student', `undergraduate student' and `diploma student' shall have the interpretations given to them in Statute 1.1 - Interpretation.

2. Subject to these regulations, the facilities of the library are available to members of Council, members of staff, and all enrolled students of the university. Others may use the library and may, in accordance with any conditions determined by the university librarian, borrow materials from the library.

3. An authorised library officer may confer upon and may withdraw from any final year undergraduate student the privileges and responsibilities conferred by these regulations upon graduate students.

Loans

4. A person shall not remove library materials from the library unless:

4.1 that person registers the loan at the loans desk or

4.2 that person obtains permission in writing from an authorised library officer.

5. A student or member of staff shall not take any library materials on loan from the library unless the loan has been recorded in accordance with library procedures at that time.

6. Books or periodicals kept in the reference section of the libraries or `rare books' which are kept in the rare book section of the library, and are so catalogued, shall not be taken on loan from the library without the written permission of an authorised library officer and in the case of rare books, the rare books librarian.

7. All library materials on loan must be returned prior to library closing time on the due date, such times being displayed by notice in the library.

8. The number of books in any category that a borrower may have on loan, and the maximum period for which they may be borrowed, shall be determined by the university librarian from time to time.

9. Notwithstanding the period for which library materials may have been lent, they must be returned to the library forthwith on demand made to the borrower by an authorised library officer either personally or by written notice.

10. A borrower shall incur a penalty for the late return of library material, such penalty being calculated in accordance with the formula displayed by notice in the library.

Reserved books

11. A person may use a reserve book in the library only for such maximum period as stated by notice at the reserve desk and thereafter, when the book is not sought by another user, only for successive periods each of such maximum period.

12. A person shall not take a reserve book on loan from the library unless permission is obtained from an authorised library officer, whereupon the loan shall be deemed to be an overnight loan.

Periodicals

13. A periodical may not be taken on loan from the library unless:

13.1 it is borrowed by a member of staff or a graduate student;

13.2 it is a periodical that is available for borrowing; and

13.3 it is borrowed only for such period as may be determined by the university librarian from time to time for a periodical of that class, and that period is displayed in the library.

Conduct

14. A library user shall not bring any bag or case into the library unless permitted to do so either on an individual basis or by publicly displayed notice.

15. A person leaving the library with any library materials must produce them for inspection by a library staff member on duty at the exit.

16.1 A library staff member delegated for the purpose or an authorised library officer may require a person, prior to leaving the library, to open for inspection a handbag, folder or other container in the person's possession, which in the opinion of the staff member or officer, has the capacity to conceal library materials.

16.2 A person must comply with a requirement made under section 16.1.

17. A library user may not talk in the library except in the entrance halls, academic staff rooms, conference rooms, discussion rooms, private study rooms, designated areas or as permitted by the university librarian.

18. A library user may not make a noise of any kind in any part of the library which disturbs or has the potential to disturb other users.

19. A person shall not -

19.1.1 smoke, eat or drink in any part of the library except in a designated area or as permitted by the university librarian;

19.1.2 destroy, damage or deface any library materials or other library property;

19.1.3 destroy, damage or injure any part of the card, microfiche or online catalogue system;

19.1.4 secrete, hide, conceal or intentionally mis-shelve any library materials in any part of the library; or

19.1.5 act or behave contrary to any published or displayed instruction issued from time to time by the university librarian.

20.1 A library staff member delegated for the purpose or an authorised library officer may demand that a person produce an identity card or other form of identification, where the person is, or apparently is, engaging or has, or apparently has, engaged in an act or apparent act of misconduct.

20.2 A person must comply immediately with a demand made under section 20.1.

20.3 A library staff member delegated for the purpose or authorised library officer may direct a person who commits, or apparently commits, or has, or apparently has, committed an act or apparent act of misconduct, to leave the library.

20.4 A person must comply immediately with a direction given under section 20.3.

Penalties and Fines

21.1 The university librarian may, from time to time, determine monetary or other penalties including ranges of and accumulating penalties, for late return and the borrower of the library materials concerned incurs the relevant penalty.

21.2 The university librarian must bring to library users' attention any determination made pursuant to section 21.1 by displaying notice of the determination in the library or other method determined by the university librarian.

21.3 A monetary penalty imposed under section 21.1 is payable within 14 days of the date of a written notice issued by an authorised library officer or a library staff member delegated for the purpose

21.4 Where, as a consequence of late return, a person incurs a monetary penalty under section 21.1 and is also forbidden to borrow library materials under section 23, the person must pay the penalty before the prohibition on borrowing library materials is removed.

22.1 An authorised library officer or a library staff member delegated for the purpose may issue, in accordance with procedures determined from time to time by the university librarian, notices of demand for the return of library materials.

22.2 If a borrower fails to return library materials as required by a notice of demand, a further notice of demand may be issued requiring the borrower to pay to the university in addition to any monetary penalty determined under section 21.1, an amount equal to the total cost of replacing the library materials including a processing charge, being an amount the university librarian determines to be the approximate cost to the University of replacing the library materials.

22.3 The amount payable under section 22.2 is payable by the borrower to whom the further notice of demand is issued within 14 days of the date of that notice.

22.4 The university librarian may reduce or remit the amount payable under either section 21.1 or section 22.2 and any reduced amount is payable by the borrower within 14 days of the date of a written notice advising the borrower of the reduction and the reason for the reduction or remission.

23. The university librarian may, after giving a person a reasonable opportunity to be heard, forbid the person to enter the library or to borrow library materials or both for such period and on such conditions as the university librarian determines where -

23.1.1 the person has repeatedly returned library materials after the date the materials should have been returned;

23.1.2 the person has not paid an amount within the time specified under these regulations;

23.1.3 the person refuses to comply with a demand under section 20.1; or

23.1.4 the person commits an act of misconduct in the library - whether or not a penalty or fine has been imposed on the person pursuant to another provision of these regulations.

24.1 An authorised library officer or a library staff member delegated for the purpose may impose a fine of an amount which does not exceed the amount of the fine which may be imposed pursuant to Statute 4.1 - Discipline by a professor or head of department, on a person who contravenes a provision of these regulations or Statute 5.2 - The University Library, other than in relation to the late return of library materials.

24.2 Subject to section 26, a fine imposed under section 24.1 is payable by the person on whom the fine is imposed within 14 days of the date of a written notice issued to that person by an authorised library officer or a library staff member delegated for the purpose.

25. A notice issued to a person under these regulations must be given or sent to the person and if sent, may be sent by post or hand delivery -

25.1.1 to the person's last known residential address; or

25.1.2 during an academic term, to the person's residential term address; or

25.1.3 in the case of a member of staff of the university to the faculty, department, centre, division, or other unit in which the member of staff is employed.

26.1 An appeal against a fine may be made to the Discipline Committee.

26.2 An appeal made pursuant to section 26.1 shall be made in writing addressed to the General Manager setting out the grounds of appeal within 28 days of the date by which the fine is payable.

26.3 The Discipline Committee shall be convened by the Academic Registrar, hear the appeal as soon as practicable after the appeal is lodged and uphold the appeal and reduce or remit the fine imposed or dismiss the appeal and confirm the fine imposed.

26.4 A confirmed or reduced fine becomes payable by the appellant within 14 days of the date of a written notice advising the appellant of the Discipline Committee's decision.

Delegation

27. The university librarian may delegate all or any of the powers and functions of the university librarian in relation to the administration, including the security, of the library to any other authorised library officer or to a library staff member.
