Constitutional law for litigators ( 6 points, SCA Band 3, 0.125 EFTSL)

Synopsis: This subject will examine the constitutional issues most likely to arise in practice, with particular focus on Ch III of the Constitution, and the requirement to provide 'just terms' for any acquisition of property. These two areas have traditionally offered the most opportunity for successful challenge. The subject will also identify areas for future development in the law, by reference to the latest constitutional cases.

Objectives: On completion of this subject, the students will be able to (1) identify potential areas for successful constitutional argument, (2) have a sound knowledge of how constitutional requirements affect the practice of law, and (3) identify areas for possible future development in constitutional law

Assessment: Written research assignment (5000 words): 50% + Final examination (2 hours): 50%
