Synopsis: This unit introduces students to the nature and function of trusts in the modern Australian legal system. Students learn how trusts are used and learn the rules governing their existence. In particular, the rules governing the creation and administration of trusts, and the rights and obligations of parties to trusts are taught.

Objectives: On completion of this unit students should be able to 1) understand the role of trusts in the modern environment; 2) explain the circumstances in which a trust should be created and the methods by which this can be done; 3) advise as to the proper administration of trusts, including the role of superannuation trustees and 4) analyse documents creating trusts and be able to describe the operation of those provisions.

Assessment: Assignment (3200 words): 40% + Examination (2 hours writing time plus 30 minutes reading and noting time): 60% OR Examination (3 hours writing time plus 30 minutes reading and noting time): 100%

Contact Hours: Three hours of lectures per week and one hour tutorial per fortnight
