Synopsis: The subject involves a study of Victorian and Federal laws on occupational health and safety, in particular the Occupational Health and Safety Act 1985 (Vic) and law reform. Topics examined include methods of regulation of workplace safety (self-regulation; criminal prosecution; common law negligence); industrial relations regulation of and approaches to workplace safety; smoking in the workplace; repetitive strain injuries; the powers of safety representatives; the right to stop work; responsibilities of employers, managers and employees in occupational health and safety; workplace stress; bullying and harassment.

Objectives: On completion of this subject students should (1) have an understanding of, and be able to critically evaluate, the methods for prescribing and maintaining standards of safety in the workplace and (2) have an understanding of the role of courts and legislatures in workplace safety.

Assessment: Research assignment (3750 words): 50% + Class participation: 10% + Take-home examination (3000 words): 40%
