Clayton Second semester 2005 (Day)
Synopsis: Module 1 'Ethics in Contract' is taken in conjunction with Contract B LAW2102. Introductory seminar followed by small group discussion of case studies raising ethical issues in the context of contractual negotiation, drafting, claims and litigation. Module 2 Legal Interviewing & Negotiation' is taken in conjunction with Torts B LAW2202. Introductory seminar followed by negotiation exercise in pairs. The multi-media version will include a Legal Interviewing exercise.
Objectives: Upon completion of this unit, students will: (a) have analysed ethical values and principles in depth in the context of contract law; (b) have been introduced to the process of client interviewing; (c) have been introduced to the process of negotiating in a legal context; and (d) have drafted terms of settlement.
Assessment: Module 1: Case study report (1200 words): 15% + Reflective report (800 words): 10% Module 2: Letter of advice (600 words): 5% + Reflective report (1200 words): 15% + Reporting letter (maximum 600 words): 5%
Corequisites: LAW2102 Contract B
