International aspects of patenting inventions in biotechnology (6 points)

Synopsis:

Objectives: This unit will examine the particular legal issues and problems that arise with respect to the patenting of biotechnological inventions. The patentability requirements, special steps in patent application procedure, claim drafting and scope of protection will be highlighted. The patent regimes wil be reviewed taking into account the obligations imposed on member countries under the Agreement on Trade Related Aspects of Intellectual Property Rights (TRIPs) as well as relevant current domestic legislation, case law and legal doctrine. Patent protection will be examined both from a technical and from an ethical perspective.

Assessment: Take home exam - 40% Research assignment - 50% Class participation - 10%
