LAW7279Electronic workplace law (6 points)(LAW) Leader: Professor Marilyn Pittard
Offered: Synopsis: This unit covers the following topics: - the impact of the new electronic workplace on the nature of work and the traditional categories of worker, including the employee/contractor distinction; - the burgeoning of consultants, "homework" and flexible employment arrangements and their significance; - rights and responsibilities of employer and employee in a workplace which is being transformed by new technology and electronic means; - changed employment rights and duties in the new contractual arrangements, including redundancy because of the introduction of new technology; - Privacy legislation and its significance in relation to the electronic workplace; - employment practices and policy re emails and use of the internet, etc; - electronic surveillance of the workplace and rights and duties of employers and workers; - sexual harrassment through the internet, the application of the Sex Discrimination Act 1984 (Cth); and the relevance of unfair dismissal laws in enforcing internet employment policy; - occupational health and safety duties and rights in an electronic workplace. Assessment: Class participation - 10% Take home exam (2800 words) - 40% Research assignment (3500 words) - 50% |
