LAW7257Uniform evidence law(LAW)
T.B.A. 6 points + City + 2 hour seminar per week plus 10 hours per week private study + Prerequisites: LAW5159 or equivalent. Synopsis: This subject is aimed at providing Victorian Legal Practitioners with an understanding of the structure and operation of the Evidence Act 1995 (Cth). As the application of the Act in Victoria is limited to Federal Courts, the subject will focus on the provisions relating to civil proceedings. The operation of the provisions of the Act will be compared with existing Victorian law, and their application will be illustrated using hypothetical scenarios. Topics will include: introduction, structure of the Act, adducing evidence, character and disposition, documentary evidence, hearsay, opinion evidence and privilege. Assessment: Examination: 50% + Essay (3000 words): 40% + Class participation: 10% |
