LAW4179International Commercial Arbitration(LAW)
Judd Epstein and Professor Vincenzo Vigoriti 6 points + intensive + First Semester + Clayton and Prato Centre + 33 contact hours, comprising: Clayton and Prato intensively, as follows: Clayton: 4 -20 March (3 weeks @ 6 hours per week. Each class will be of 2 hrs duration. Total = 18 hrs); Plus Prato: 24-30 April and 6 -8 May, one week 7 hrs, one week 8 hours, total = 15 hours.Total class contact hours for the unit = 33 hours. Synopsis: The object of this course will be to examine the principles and practices of this new area as reflected in the rules of the major arbitration institutions, the national arbitration laws (with particular emphasis on Australia) and arbitral tribunal decisions. The topics to be considered in the course include: the nature of international arbitration, the types of arbitration, the legal framework, the agreement to arbitrate, judicial enforcement of the agreement, the powers of the tribunal and the conduct of the arbitration, the arbitral award and challenge to the award Assessment: 2 hour examination 100%; or at an individual student's option: 50% examination of 1 hour; and 50% research essay of 4,000 words. The latter option is available only to students undertaking the essay in Australia. |
