The nature and sources of commercial law. Categories of commercial and consumer transactions. Misrepresentation and misleading conduct. The formal requirements for entry into contracts of sale and related kinds of agreement. Sellers' and manufacturers' liability for product defects. The rules governing transfer of title to goods by a non-owner. Passing of property, risk and frustration. Remedies for breach of contract. Unconscionable contracts. Assessment: Optional written assignment (2000 words): 30% + Final examination (1 hr 20 mins or 2 hours): 70% or 100% |
