Drugs and the law

Synopsis: The central focus of the course is upon analysis of investigation, substantive, evidentiary, procedural and sentencing issues germane to the Victorian and Federal laws and systems. Topics include: proscription and regulation of drug use; nature, incidence and pharmacology of dependence; State and Federal responsibilites, policies and jurisdiction; detection; investigation; prosecutorial discretions; pre-trial issues; substantive laws; evidentiary problems; proof at sentence; sentencing: drug offences; sentencing drug-related offences; rehabilitation and treatment; confiscation and allied orders; parameters of criminal regulation; systemic reform.

Assessment: Research paper (3000 words): 40% + Research paper (3000 words): 40% + Seminar participation: 20%
