LAW7016Creditors and family law(LAW) Not offered in 2001 Associate Professor Dorothy Kovacs 6 credit points + One 2-hour seminar per week + City Synopsis: The interaction between the legal rights of creditors and those of litigants in family law proceedings. Third party rights. The interactions of family law and bankruptcy law. The position of creditors where equitable interests are asserted by parties to a marriage in Family Court and Federal Court proceedings. Specific issues affecting lenders and borrowers including liability of guarantors. Assessment: Research assignment (3000 words): 40% + Class presentation/participation: 10% + Supervised examination (1.5 hours): 50% |
