LAW4172Human rights in Australian law 406(LAW)
Professor David Kinley 6 credit points + Three 1-hour lectures per week + Second semester + Clayton Synopsis: The subject seeks to provide comprehensive coverage of the wide-ranging legal forms, policies and practices in Australia that relate to the upholding of human rights standards. The perspective adopted is new in the sense that human rights laws are not viewed as simply being those laws that expressly refer to rights protection. Rather it is to recognise that in the absence of a strong jurisprudential culture of rights in the Common law world generally, and certainly in Australia, laws protecting as well as infringing human rights nonetheless are apparent. Assessment: Optional research paper (4000 words): 50% + supervised examination (1 hour plus reading time): 50% OR optional student placement, consisting of assessment by external supervisor (20%) + essay of 2000 words (30%): 50% AND supervised examination (1 hour plus reading time): 50% OR Supervised examination (2 hours plus reading time):100% N.B: Students that complete the optional student placement cannot also undertake the optional research paper |
