Legal rights and obligations for managers

6 points + 3 hours per week + First, second semester + Caulfield + This subject may be covered over three two-day weekends.

Objectives On completion of this subject students should understand the common law and legislation which currently govern the management of staff; be aware of the volatility of the relevant law; be alerted to indicators of imminent changes in relevant law from industry, peak industrial bodies and parliamentary debate and pronouncements.

Synopsis Topics include introduction to the common law and legislation which controls the management of staff; instruction in the law affecting the selection, recruitment and termination of staff; employment contracts and their implications; the industrial relations commissions court; workplace health and safety and other legal forums; union relationships and industrial action; tortious liability of management; wages and salary administration, suspension and stand down; anti-discrimination law.

Assessment Major project assignment (4000 words): 40% + Examination (3 hours): 60%
