Synopsis

Legal implications of staff-management decisions. Individual employer-employee relationship; contract of employment; wages-work bargain; recruitment law; discrimination law; termination law including unfair dismissals; mutuality of legal rights and obligations; health and safety law in the workplace; vicarious liability; industrial action and constitutional considerations.

Outcomes

The learning goals associated with this unit are to:

  1. extend their knowledge and comprehension of the legal framework governing workplace relations in Australia
  2. evaluate the principles underlying employment laws and assess the law's impact on the employment relationship
  3. demonstrate a working knowledge of employment law issues through the application of legal principles to a range of hypothetical scenarios
  4. identify and analyse current issues involving legal regulation of the workplace.

Assessment

Within semester assessment: 40%
Examination (3 hours, open-book): 60%
