Synopsis

An introduction to the South African legal system, its history, structure and sources of law. Particular emphasis is placed on the law as it affects business. The laws of delict and contract as they affect business are examined. The basic principles of the law of partnership and companies are also examined.

Objectives

The learning objectives of this unit are to:

  • Accurately describe and define the South African Legal system, its history, structure and sources of law;
  • Accurately explain the basic rules of statutory interpretation;
  • Accurately identify and discuss the application of the law of delict, contract, agency and unjustified enrichment to a range of situations in business;
  • Accurately distinguish particular nominated contracts, and discuss the application of the rules of these nominated contracts to a range of situations in business.

Assessment

Within semester assessment: 30%
Examination (3 hours, open book): 70%
