Synopsis

Topics include the preparation and presentation of cases and submissions before industrial relations and other administrative tribunals; negotiation and administration of the collective agreement. Issues dealt with include grievance and disciplinary procedures; unfair dismissals; strategy and tactics in industrial negotiations; management and union rights; drafting the collective agreement.

Objectives

The learning goals associated with this unit are to:

• analyse the relationship between advocacy and bargaining
• analyse written submissions as advocacy
• develop basic advocacy research skills for case preparation
• develop basic advocacy presentation skills for case presentation
• examine the roles of tribunals and employer and union advocates in determining employment conditions
• actively reflect upon the skill development processes underpinning successful advocacy and bargaining.

Individual assignment (2500 words): 30% Individual assignment (1500 words): 20%
Group presentation (Moot case): 20%
