Bachelors degrees


1. Faculty information handout

The faculty information handout consisting of the Faculty of Law regulations and these resolutions shall be made available online at the Faculty of Law web page and a copy shall be available for consultation at the Student Administration office at the faculty. (Regulation 2.1.)

2. Completion of a unit

2. A candidate completes a unit when the board of examiners or the dean after taking into account his or her performance:
2.1 in the unit examination for that unit;
2.2 in lectures, seminars and tutorials specified as part of that unit; and
2.3 in written or oral work specified as part of that unit; is satisfied that he or she has attained at least a pass standard. (Formerly Regulation 7.)

3. Unit examinations

Pursuant to the `Examinations regulations' the dean may, in his or her discretion, determine that there shall be no unit examination in a unit. (Formerly Regulation 8.)

4. Power to refuse admission to unit examinations

4.1 For the purposes of this resolution, the dean may specify as a requirement of a unit one or more of the following:
4.1.1 attendance at lectures;
4.1.2 attendance at seminars;
4.1.3 attendance at tutorials;
4.1.4 completion of written or oral work.
4.2 Where a candidate has not complied with the requirements of a unit specified by the dean pursuant to resolution 4.1, the dean may, in his or her discretion, refuse to admit the candidate to the unit examination for that unit. (Formerly Regulation 9.)

5. Classification of candidate's work

5.1 When a candidate for the degree of Bachelor of Laws successfully completes a unit, the examiners shall classify the candidate's work into one of the following grades: high distinction (HD); distinction (D); credit (C); pass (P).
5.2 A candidate who fails to successfully complete a unit shall be given the grade of fail (N). (Formerly Regulation 13.)

6. Calculation of time limits

6.1 Notwithstanding anything to the contrary appearing in Faculty of Law regulations section 7, where a candidate is credited with a unit towards his or her course the maximum period within which he or she is required to complete his course shall be reduced by a period of three months for each unit so credited. For the purpose of this subsection:
6.1.1 a unit which represents 12 and a half per centum of a normal workload of a full-time candidate for a year, shall be regarded as one unit, and
6.1.2 a unit which represents more or less than 12 and a half per centum of a normal workload of a full-time candidate for a year shall be regarded as more or less than one unit to an extent proportionate to the ratio which the percentage it represents bears to 12 and a half per centum. 6.2. For the purposes of section 7, the period of candidature shall be calculated from the date on which the candidate is first enrolled in the faculty as a candidate provided that, in the case of a candidate enrolled in more than one faculty, the period shall be calculated from the date on which he or she first enrolled in the other faculty. (Formerly Regulation 17.)

7. Prerequisites of candidature

The dean may, in his or her discretion, recommend that a person be admitted to a law degree referred to in this part notwithstanding that the person was not a candidate for that degree when he or she completed each unit for that degree. (Formerly Regulation 18.)

8. Unit requirements - a candidate other than a candidate enrolled in more than one faculty

8.1 Subject to these resolutions, a candidate other than a candidate enrolled in more than one faculty shall, if a candidate with a prior qualification, qualify for the degree of Bachelor of Laws upon complying with the requirements of resolution 8.2.
8.2 A candidate, other than a candidate enrolled in more than one faculty, must complete law units available in the faculty to which the board has attributed a total value of 156 credit points which units shall include elective units; and
8.2.1 `Legal process', `Contract', `Torts', `Constitutional law', `Criminal law and procedure', `Property', `Administrative law', `Skills, ethics and research A', `Skills, ethics and research B', `Skills, ethics and research C' and `Skills, ethics and research D'.
8.3 Subject to these resolutions, a candidate other than a candidate enrolled in more than one faculty shall, if not a candidate with a prior qualification, qualify for the degree of Bachelor of Laws upon complying with the requirements of resolution 8.2 (save that the total value of credit points shall be 192). 9. Unit requirements - a candidate enrolled in more than one faculty

9. A candidate enrolled in more than one faculty shall:
9.1 qualify for the degree of Bachelor of Arts, Bachelor of Business (Banking and Finance), Bachelor of Business (Management), Bachelor of Business Systems, Bachelor of Commerce, Bachelor of Computer Science, Bachelor of Economics, Bachelor of Education, Bachelor of Engineering, Bachelor of Medicine and Bachelor of Surgery, Bachelor of Music, Bachelor of Performing Arts, Bachelor of Science, Diploma of Psychology, or such other bachelors degree or diploma as the board may from time to time approve;
9.2 Subject to resolution 9.2.2 complete (while a candidate for one of the degrees referred to in the preceding resolution or subsequently) law units available in the faculty to which the board has attributed a total value of 156 credit points which units shall include elective units and those in 9.2.1
9.2.1 `Legal process', `Contract', `Torts', `Constitutional law', `Criminal law and procedure', `Property', `Administrative law', Skills, ethics and research A, Skills, ethics and research B, Skills, ethics and research C and Skills, ethics and research D.
9.2.2 In the case of a candidate for the degree of Bachelor of Medicine/ Bachelor of Surgery or Bachelor of Education the total value of law units required to be completed shall be 144 credit points. (Formerly Regulation 27.)

10. The degree - pass or with honours

10.1 For the purpose of making a determination under Faculty of Law regulations section 10, the dean must -
10.1.1 have regard to the candidate's performance in all units offered by the faculty and undertaken by the candidate towards the degree; and
10.1.2 in respect of a candidate who has satisfactorily completed honours research unit 512 [LAW5207] add a bonus of 20 per cent to the mark obtained by the candidate in that unit. (Formerly Regulation 29.)

11.Classification - Bachelor of Laws with honours

The degree of Bachelor of Laws with honours must be classified as Class 1, Class II Division A, Class II Division B or Class III. (Formerly Regulation 29.)

12. Unit sequence

The normal full-time workload is 48 points per year.
The normal sequence in which units are undertaken in each of the courses offered by the Faculty of Law is set out below.

LLB (three year)

12.1 Except with the approval of the dean, a candidate for the degree of Bachelor of Laws under section 26.2.1 of the Faculty of Law regulations, shall enrol:
12.1.1 in the first year of enrolment for `Legal process', `Contract', `Torts', `Criminal law and procedure', `Skills, ethics and research A' and `Skills, ethics and research B';
12.1.2 in the second year of enrolment for `Property', `Constitutional law' (6 cps), and 30 points elective law units;
12.1.3 in the third year of enrolment for `Administrative law' (6 cps), `Skills, ethics and research C' and `Skills, ethics and research D' and 42 points elective law units.

LLB (four year)

12.2 Except with the approval of the dean, a candidate for the degree of Bachelor of Laws under section 26.3 of the Faculty of Law regulations, shall enrol:
12.2.1 in the first year of enrolment for `Legal process', `Criminal law and procedure', `Contract', `Torts', `Skills, ethics and research A' and `Skills, ethics and research B';
12.2.2 in the second year of enrolment for `Property', `Constitutional law' (6 cps) and 30 points elective law units;
12.2.3 in the third year of enrolment in `Administrative law' (6 cps), `Skills, ethics and research C' and 36 points elective law units;
12.2.4 in the fourth year of enrolment in `Skills, ethics and research D' and 42 points elective law units.

BA/LLB

12.3 Except with the approval of the dean, a candidate for the degrees of Bachelor of Arts and Bachelor of Laws shall enrol:
12.3.1 in the first year of enrolment for non-law units totalling 24 points, `Legal process', `Criminal law and procedure' and `Skills, ethics and research A';
12.3.2 in the second year of enrolment for non-law units totalling 42 points, `Contract' and `Skills, ethics and research B';
12.3.3 in the third year of enrolment for non-law units totalling 30 points, `Torts' and `Property';
12.3.4 in the fourth year of enrolment for `Constitutional law' (6 cps), `Skills, ethics and research C' and 36 points elective law units; and
12.3.5 in the fifth year of enrolment for `Administrative law' (6 cps), `Skills, ethics and research D' and 36 points elective law units.

BBus(Bkg&Fin)/LLB

12.4 Except with the approval of the dean, a candidate for the degree of Bachelor of Business (Banking and Finance) and Bachelor of Laws shall enrol:
12.4.1 in the first year of enrolment for non-law units totalling 24 points, `Legal process', `Criminal law and procedure' and `Skills, ethics and research A';
12.4.2 in the second year of enrolment for non-law units totalling 42 points, `Contract' and `Skills, ethics and research B';
12.4.3 in the third year of enrolment for non-law units totalling 36 points and `Property';
12.4.4 in the fourth year of enrolment for `Torts', `Constitutional law' (6 cps), `Skills, ethics and research C' and 30 points elective law units; and
12.4.5 in the fifth year of enrolment for `Administrative law' (6 cps), `Skills, ethics and research D' and 42 points elective law units.

12.5 Except with the approval of the dean, a candidate for the degree of Bachelor of Business (Management) and Bachelor of Laws shall enrol:
12.5.1 in the first year of enrolment for non-law units totalling 36 points, `Legal process' and `Skills, ethics and research A';
12.5.2 in the second year of enrolment for non-law units totalling 36 points and `Criminal law and procedure';
12.5.3 in the third year of enrolment for non-law units totalling 24 points, `Contract', `Torts' and `Skills, ethics and research B';
12.5.4 in the fourth year of enrolment for `Property', `Constitutional law' (6 cps), and 30 points elective law units; and

12.6 Except with the approval of the dean, a candidate for the degree of Bachelor of Business Systems and Bachelor of Laws shall enrol:
12.6.1 in the first year of enrolment for non-law units totalling 24 points, `Legal process', `Criminal law and procedure' and `Skills, ethics and research A';
12.6.2 in the second year of enrolment for non-law units totalling 36 points, `Contract' and `Skills, ethics and research B';

12.7.2 in the second year of enrolment for non-law units totalling 36 points, `Contract' and `Skills, ethics and research B';
12.7.3 in the third year of enrolment for non-law units totalling 36 points and `Property';
12.7.4 in the fourth year of enrolment for `Torts', `Constitutional law' (6 cps), `Skills, ethics and research C', `Corporations law' and 24 points elective law units; and

12.8 Except with the approval of the dean, a candidate for the degree of Bachelor of Computer Science and Bachelor of Laws shall enrol:
12.8.1 in the first year of enrolment for non-law units totalling 24 points, `Legal process', `Criminal law and procedure' and `Skills, ethics and research A';
12.8.2 in the second year of enrolment for non-law units totalling 42 points, `Contract' and `Skills, ethics and research B';
12.8.3 in the third year of enrolment for non-law units totalling 42 points and `Property';
12.8.4 in the fourth year of enrolment for `Torts', `Constitutional law' (6 cps), `Skills, ethics and research C' and 30 points elective law units;

12.9 Except with the approval of the dean, a candidate for the degree of Bachelor of Engineering (Chemical) and Bachelor of Laws, Bachelor of Engineering (Civil) and Bachelor of Laws, Bachelor of Engineering (Electrical) and Bachelor of Laws, Bachelor of Engineering (Industrial Engineering and Engineering Management) and Bachelor of Laws, Bachelor of Engineering (Materials) and Bachelor of Laws or Bachelor of Engineering (Mechanical) and Bachelor of Laws shall enrol:
12.9.1 in the first year of enrolment for such non-law units as are required by the Faculty of Engineering;
12.9.2 in the second year of enrolment for such non-law units as are required by the Faculty of Engineering, `Legal process' and `Skills, ethics and research A';
12.9.3 in the third year of enrolment for such non-law units as are required by the Faculty of Engineering and `Criminal law and procedure';
12.9.4 in the fourth year of enrolment for such non-law units as are required by the Faculty of Engineering, `Contract', `Torts' and `Skills, ethics and research B';
12.9.5 in the fifth year of enrolment for `Property', `Constitutional law' (6 cps) and 30 points elective law units; and
12.9.6 in the sixth year of enrolment for `Administrative law' (6 cps), `Skills, ethics and research C', `Skills, ethics and research D' and 42 points elective law units.

BEc/LLB

12.10 Except with the approval of the dean, a candidate for the degree of Bachelor of Economics and Bachelor of Laws shall enrol:
12.10.1 in the first year of enrolment for non-law units totalling 24 points, `Legal process', `Criminal law and procedure' and `Skills, ethics and research A';
12.10.2 in the second year of enrolment for non-law units totalling 36 points, `Contract' and `Skills, ethics and research B';
12.10.3 in the third year of enrolment for non-law units totalling 36 points, and `Property';
12.10.4 in the fourth year of enrolment for `Torts', `Constitutional law' (6 cps) `Skills, ethics and research C' and 30 points elective law units; and

12.16 Except with the approval of the dean, a candidate for the degree of Bachelor of Laws and Diploma of Psychology shall enrol:
12.16.1 in the first year of enrolment for non-law units totalling 12 points, `Legal process', `Contract', `Criminal law and procedure', `Skills, ethics and research A' and `Skills, ethics and research B';
12.16.2 in the second year of enrolment for non-law units totalling 24 points, `Torts' and `Property';
12.16.3 in the third year of enrolment for non-law units totalling 12 points, `Constitutional law' (6 cps), `Skills, ethics and research C' and 36 points elective law units;
12.16.4 in the fourth year of enrolment for non-law units totalling 12 points, `Administrative law' (6 cps), `Skills, ethics and research D' and 36 points elective law units;

13. Compulsory units

The compulsory units specified in resolutions 8.2.1 and 9.2.1 above, shall be attributed the credit point values as listed in table 1.

14. Elective units

14.1 the elective units available in the faculty shall be the units listed in table 2;
14.2 each such unit shall be taught over the period set out in the table;
14.3 the points to be attributed to each elective unit shall be as set out in the table.
14.4 The research unit and units referred to in the table require individual research under supervision. Each research unit or unit will need individual approval and no research unit or unit will be approved unless a suitably qualified member of staff is available with adequate time to supervise the research. The research involved will normally take place over a period of not less than three calendar months and not more than 12 calendar months. The points attributed to the research unit or unit shall be either six or 12 according to the work involved.

15. Prerequisites

Except with the approval of the associate dean (Student Affairs) in consultation with the chief examiner, no candidate for any of the following units may enrol in such units unless, prior to such enrolment, he or she has completed `Legal process', the unit or units listed in column A of table 3, and has either, prior to such enrolment, completed, or is concurrently enrolled in, the unit or units listed in column B.

17. Honours classification and order of merit

17.1 The award of honours shall be based on the average of the weighted percentage grades awarded to a candidate in each law unit taken in the Monash Faculty of Law as part of his or her degree.
17.2 A bonus of 20 per cent will be applied to the mark obtained in `Honours research subject 512' [LAW5207]. This bonus will apply solely for the purpose of calculating the award of honours and classification of honours.
17.2.1 A student may not enrol in `Honours research unit 512' (LAW5207) without the consent of the director, Honours Program to the enrolment and to the proposed research topic.
17.3 In December of each year, or as soon as practicable thereafter, a list will be prepared of all candidates who have in that calendar year completed all the requirements for the degree of Bachelor of Laws and are eligible for the award of honours. This list shall be arranged in order of merit and show the class of honours recommended in respect of each candidate.
17.3.1 Candidates will only be considered for inclusion in the order of merit list for honours if a final mark in every unit required for completion of the requirements for the degree of Bachelor of Laws is available to the Honours Committee at the time the committee is determining the order of merit list.
17.3.2 Candidates who complete all the requirements for the degree of Bachelor of Laws as a result of supplementary or special (deferred) examinations in January or February will be eligible to apply to be included among the candidates awarded a Bachelor of Laws degree with honours in the immediately preceding calendar year. Such candidates are required to apply to the Honours Committee in writing for such inclusion, giving details of their results in the supplementary or special (deferred) examination(s). These candidates will not be included in the order of merit list of the preceding calendar year.
17.3.3 Candidates who do not make application in accordance with resolution 17.3.2 will, as a matter of course, be considered for the award of the degree of Bachelor of Laws with honours and inclusion in the order of merit list of the year in which they take the supplementary or special (deferred) examination(s) if their average weighted percentage grade warrants the award of the degree of Bachelor of Laws with honours.
17.3.4 Candidates will not be considered for the award of the degree of Bachelor of Laws with honours if they have already taken out the degree of Bachelor of Laws from Monash University.
