The subject will cover the law relating to commercial designations such as trade marks for goods, service marks for services, collective or certification marks and trade names for industrial and commercial enterprises. This involves a detailed study of the provisions of the Trade Marks Act 1955 (Cth), including the registrability and registration of trade marks, the protection granted by registration, and the maintenance and exploitation of a registered trade mark. The law of passing-off, unfair competition and the protection granted by the Trade Practices Act 1974 (Cth) and the Fair Trading Act 1985 (Vic.) as far as they relate to the protection of commercial designations will also be covered in detail.
