One 2-hour seminar weekly over 13 weeks

The object of this subject is to provide instruction at an advanced level in legal questions associated with the establishment and operation of administrative tribunals and public inquiries (eg royal commissions and boards of inquiry and inquiries by parliamentary committees), and with administrative appeals. Particular matters dealt with in the subject include the role of tribunals and their relationship with other institutions of government, eg ministers, departments of state and the courts of law; conduct of proceedings before tribunals and public inquiries and legal constraints thereon; powers of tribunals in relation to procurement of evidence; rights and duties of witnesses; evidentiary questions; contempt of tribunals and enforcement of tribunal decisions; duties to give reasons for decision; varieties of appeal against administrative decisions and the roles of administrative appeal tribunals.

Assessment

Written assignment (5000 words): 50% * Examination (3 hours): 50%
