Sentencing 700

One 2-hour seminar weekly over 13 weeks * First semester

The subject will examine the sentencing functions of the legislature, judiciary and the executive; the variety of sanctions available to the judiciary under State and Federal law; sentencing theories and practice in Victorian courts; control of sentencing discretion, ancillary problems related to sentencing, eg preparation and use of pre-trial and pre-sentence reports; problems of research into sentencing practices and Federal and State proposals for sentencing law reform.

Assessment

Two written research assignments: 5000 words each (50% each) * or in exceptional circumstances, one written research assignment: 10,000 words (100%)
