This is a course on drafting documents for family lawyers. It covers (1) drawing pleadings under the Family Law Act including the pleading of matters cross-vested into the Family Court; (2) drawing maintenance agreements under the Family Law Act; (3) drafting pleadings under state law, preparing an originating motion and drafting interrogatories and answers, particularly as these affect de facto property claims; (4) drafting interlocutory applications under state law; (5) Drafting caveats, court orders and terms of settlement. The relevant substantive law, procedural requirements and Rules of Court will be considered.
Assessment
Research assignment (4000 words): 40% * Class participation and class presentation: 10% * Final exam (three-hour open-book): 50%
