This subject is concerned with the legal problems arising from international commercial transactions. It includes some topics which are considered in greater depth in other subjects such as government regulation of international trade and international banking. The object is to study (i) the nature of the problems arising from the international aspect of trade transactions; (ii) how the law of sales, negotiable instruments, carriage, securities and settlement of disputes is affected when goods cross national boundaries so that two or more legal systems are involved; (iii) what steps have been taken or are proposed by international agreement to resolve or reduce the problem. Topics to be studied will include (a) litigation as a mode of dispute resolution - jurisdiction, choice of law and enforcement of judgements; (b) alternative dispute resolution - arbitration, mediation and conciliation; (c) international trade contracts; (d) government regulation and anti-trust; (e) finance and transport.
Assessment
Class participation: 10% * Written research assignment (8500 to 9500 words): 90% * or written research assignment (4000 to 5000 words) and written case study assignment (4000 to 500 words): 45% each
