Current issues in international banking law

Associate Professor W Weerasooria

One 2-hour seminar weekly over 13 weeks * Second semester

This subject is concerned primarily with the legal relationships set up by different forms of international and domestic bank finance. The principal focus of the subject is on the nature and effect of various contractual provisions designed to assure payment by the debtor, whether by way of real security (eg mortgage or charge) quasi-security device (eg set-off or negative pledge) or an additional personal obligation (eg guarantee, letter of comfort or performance bond). The impact of insolvency on creditor's rights and applicable conflicts of law rules will also be considered. The subject will also consider relevant changes in the practice and regulation of banks and capital markets.

Assessment

Written research assignment (5000 words): 50% * Terminal examination (3 hours) 40% * Class presentations/participation: 10%
