This subject will consider topics of current interest in Australian civil procedure. The subject will be taught on a modular basis with issues for discussion changing from year to year. The treatment of topics will be for the most part theoretical rather than `how to do it'. Where a jurisdiction outside Victoria provides an interesting or alternate solution to the practice here, that solution will be examined. The subject will utilise the comparative method. The focus of the subject may alter with later developments. At present, the following topics are likely to be examined: the cross-vesting legislation and practice; Anton Piller orders, Mareva injunctions and other injunctive relief, judicial management; representative and class actions; stays of proceedings; costs including contingency fees and commercial arbitration.
Assessment
Each student to choose from: Final examination (formal, 3 hours) * Take-home examination (48 hours) * Research paper (10,000 words) * Two research papers (5000 words each)
