Corporate insolvency 515

15 points * Three 1-hour lectures per week * First semester * Clayton

This subject involves the study of the law governing corporate insolvency. Topics covered will include some or all of the following: the objectives of corporate insolvency law; the meaning of insolvency and its legal implications; the insolvent trading provisions of the Corporations Law; directors' duties to creditors; an outline of the procedures involved in a winding up application; property available to creditors in a winding up; claims which can be made in a winding up; distribution of property; alternatives to winding up.

Assessment

Optional written research assignment (3000 words): 30% * Examination (2.5 hours): 70% * Or examination (3.5 hours): 100%
