Trade marks and commercial designations 515

This subject is concerned with the protection of trade marks and other commercial designations used in the promotion and marketing of goods and services. It involves a study of the registration and protection of trade marks pursuant to the Trade Marks Act 1955 (Cth); and also a study of the action for passing off and associated torts, as well as a consideration of relevant parts of the Trade Practices Act 1974 (Cth), the Fair Trading Act 1985 (Vic.), and other legislative schemes for the protection of names and symbols. International aspects of protection may also be considered, and the development of laws against unfair competition generally will be discussed.

Assessment

Optional written research assignment (4500-5000 words): 50% * Terminal examination (1.5 hours or 3 hours): 50% or 100%
