This subject examines the various kinds of commercial credit transaction used in Australia, and the rights and remedies of creditor and debtor. The emphasis is on secured transactions. Topics to be covered include (1) real property securities; (2) chattel securities (including hire-purchase and finance leasing); (3) receivables financing; (4) company securities (with particular reference to the floating charge, and the registration requirements of the corporations law); (5) Romalpa agreements; and (6) guarantees (if time).
