Civil procedure B 515

15 points * Three 1-hour lectures per week * One hour of drafting pleadings (optional) * First/Second semester * Clayton

This subject is a one-semester alternative to the two-semester subject LAW5201 (Civil procedure A 530). The objects of the subject are to provide the student with an understanding of the fundamental concepts of civil procedure, to explore the application of the most important rules of the Supreme Court of Victoria, and to provide an overview of civil litigation from the decision to sue to the certification that the proceeding is ready for trial. While LAW5104 (Civil procedure B 515) covers the necessary elements of the civil process, it does not incorporate as broad a range of material as LAW5201 (Civil procedure A 530).

Assessment

Terminal examination (3 hours): 100% * At student option, terminal examination 75%, drafting exercise 25% or case study 25%
