This subject is concerned with land use controls exercised by municipal councils and other planning authorities. The following are the topics which will be studied. Town and country planning: the history of attempts to plan the use of land, with particular reference to Victoria. The objectives of planning; the scheme and operation of the Planning and Environment Act 1987 (Victoria); the content, preparation and approval of planning schemes; non-conforming uses; the operation of the permit system; the scope of the discretion of responsible authorities in dealing with permit applications and attaching conditions; appeals from, and judicial review of, the exercise of such discretion; enforcement of schemes; compensation and planning, including compensation for compulsory acquisition of land.
Assessment
Written research assignment (5000 words): 50% * Take-home terminal examination (48 hours): 50%
