Law of employment 415

This subject involves (1) an analysis of the contract of employment (including employment agreements in Victoria under the Employee Relations Act 1992 (Vic.) and the rights and duties of employer and employee as implied by the common law; (2) a study of the remedies of employer and employee under the contract; (3) an examination of Federal and State laws of unfair dismissal; (4) an evaluation and study of some of the major aspects of safety legislation as presently in force in Victoria, and in particular the Occupational Health and Safety Act 1985 (Vic.) and the Accident Compensation Act 1985 (Vic.); (5) an examination of discrimination in employment, with particular reference to the Sex Discrimination Act 1984 (Cth) and the Equal Opportunity Act 1984 (Vic.).

Assessment

Written research assignment: 30% * Terminal examination (3 hours): 70%
