Constitutional law of Malaysia 415

Not offered in 1995

15 points * Three 1-hour lectures per week * Clayton

The purpose of this subject is to make the student familiar with the general principles of the constitutional law of Malaysia and also with many of the details of the framework within which the federal government of Malaysia and governments of the thirteen states of Malaysia operate. The written constitution of Malaysia and, where necessary, the constitutions of the thirteen states will be examined to see how the constitutions have worked out in practice. The problems that have been faced by the legislators, the executive and the judiciary in making the constitutions work will be considered. Although it is not principally a course in comparative constitutional law, useful comparisons will occasionally be drawn between the way similar constitutional matters and issues are dealt with in Australia, Britain, India and Singapore - countries whose constitutional law has had the greatest influence on the constitutional law and practice of Malaysia.

Assessment

Written research assignment (5000 words): 60% * Terminal examination (2 hours): 40%
