Objectives This subject aims to provide students with an understanding of the significance of the principles of contract as the basis of personal, professional and business relationships. It also aims to develop a knowledge of the rules of interpretation and precedent with regard to contracts of in the several Australian jurisdictions. Students acquire a capacity to identify breaches of contract, and to recognise the appropriate remedies for such breaches. This knowledge allows progression to further study of the law relating to business entities such as companies, partnerships, sole traders and trusts.
Synopsis Introduction to contract law in Australia, offer and acceptance, intention to be legally bound, consideration terms, capacity of parties, problems of consent, legality of object, principals and agent fruustration, termination of contract. Goods Act (1958) (Victoria) consumer protection and an introduction to the Trade Practices Act, rights and remedies under the Act.
Assessment Written (two assignments 3000 words): 30% * Examination (3 hours): 70%
